Take the 5th, Lose Your Stuff
Being a collections lawyer in Dallas is never boring.
We took the deposition of a judgment debtor and in that deposition he asserted his Fifth Amendment right against self-incrimination on 792 separate occasions. So we went to see the court about overruling those assertions and the court was all too happy to overrule the assertion.
And then the court also ordered that certain assets be turned over to the sheriff for sale.
Debtors sometimes try all kinds of maneuvers to avoid their obligations. But often, they just dig the hole deeper. Judges just don’t tolerate that kind of gamesmanship from someone that owes a judgment.
